In my last blog post I noted that there has been a lot of discussion online and in the news this year about alternatives to using the services of a traditional, licensed realtor for buying or selling your house. I’ve been a little concerned that the “crusade for the consumer” has left out important information about this business and, although I recognize that the business of real estate isn’t perfect, there are safeguards built in to the system to help people participating in the real estate market ensure they are protected.
My last blog talked about the Real Estate Council of Ontario (RECO) and the Multiple Listing Service (MLS). This week I want to go into a little more detail about other issues that support professionalism in this industry. Other ways the consumer is protected:
The various structured, legislated bodies, to which we all belong, including real estate boards (local, provincial and national) and brokerages. Realtors pay numerous fees and expenses that are dedicated to activities in support of consumer protection and quality service– real estate board and brokerage fees, for example, and errors and omissions insurance. Many of us are also active volunteers who devote many hours to serving our real estate boards in the interests of supporting the professional conduct of real estate in our communities. They belong to Professional Standards and Government Relations committees that do things such as lobby governments to reject initiatives such as the Municipal Land Transfer Tax.
The brokerage fees go towards ensuring our customers have a professional environment in which to meet us and that appointments are made, telephones are answered at all hours of the day and night, and that every deal is filed, audited and recorded for regulation. Our brokerages also give us a community that supports a professional approach to our work: if I have a question around a complex issue that I haven’t encountered before, my brokerage gives me access to other experienced professionals, and the company lawyer, so that I can get advice for my clients when I need it.
Regulation around money laundering. The federal government has mandated that every real estate transaction requires the completion of a Fintrac declaration that helps facilitate the detection, prevention and deterrence of money laundering. The government has also put us on the front line of detecting people who are attempting to avoid paying their taxes.
Real estate salespeople have a fiduciary duty to provide honest and ethical service. That means that we are legally required to behave with integrity and we have a legal duty to avoid misrepresentation.
These are all important issues and I support a high degree of professionalism in this business. We have a ways to go before every single realtor in the country reflects a high standard of ethical behaviour and I get that. You’ll hear the same story in the fields of law and medicine, by the way.
